In fact, it\u2019s yet another facet of the increasingly surreal popular cultural context of the 2020 US election. YMCA has been on Donald Trump\u2019s playlist at rallies for well over a year, and the <a href=\"https:\/\/www.bbc.co.uk\/news\/av\/world-us-canada-54740177\">Village People<\/a> are on a long list of artists who \u2013 as in 2016 \u2013 have asked the president\u2019s campaign to <a href=\"https:\/\/theconversation.com\/trump-slammed-by-musicians-for-appropriating-music-but-pop-and-politics-have-a-long-history-63901\">stop using their music<\/a>.<\/p>\n<p>Various levels of denunciation and threats of legal action have come from, among others, <a href=\"https:\/\/www.dailymail.co.uk\/news\/article-8881653\/Phil-Collins-hits-Trump-cease-desist-letter-stop-playing-Air-Tonight.html\">Phil Collins<\/a>, the <a href=\"https:\/\/www.bbc.com\/news\/world-us-canada-53208593\">Rolling Stones<\/a>, <a href=\"https:\/\/www.nme.com\/news\/music\/neil-young-is-suing-donald-trump-for-the-unauthorised-use-of-his-music-2721139\">Neil Young<\/a> and Queen \u2013 whose guitarist Brian May has called it an \u201c<a href=\"https:\/\/www.nme.com\/news\/music\/queen-say-they-are-in-an-uphill-battle-to-stop-donald-trump-using-their-songs-in-his-election-campaign-2736199\">uphill battle<\/a>\u201d to get the Trump campaign to stop playing the band\u2019s 1977 hit We Are The Champions.<\/p>\n<p>Given all the other accusations that have been ranged against him \u2013 from sexual assault to the illegal use of military aid to pressure a foreign country into investigating his Democrat rival \u2013 Trump\u2019s skirting of copyright regulations might seem like a comparatively small matter. And indeed, there are limited provisions for artists to stop the use of their music.<\/p>\n<p>But there\u2019s a strong connection between, and investment in, the relationship between pop culture and electioneering in the US. The use of songs at rallies \u2013 as opposed to, for instance, television spots \u2013 is generally covered by the <a href=\"https:\/\/www.rstreet.org\/wp-content\/uploads\/2016\/08\/Political-Entities-Org_POL1.2016_1.pdf\">licenses<\/a> for performing rights collection societies ASCAP and BMI, with packages of songs available for use that number into the millions.<\/p>\n<p>Artists can withdraw their material from these packages, <a href=\"https:\/\/completemusicupdate.com\/article\/the-rolling-stones-team-up-with-bmi-to-try-to-stop-trumps-use-of-their-songs\/\">and the Stones have done so<\/a>, as Rihanna did in 2018. Even if the broader license that applies to the venues themselves might still pertain, it\u2019s fraught territory that is being explored in greater depth now than previously due to the obduracy of the Trump campaign.<\/p>\n<p>Other options include recourse to a \u201c<a href=\"https:\/\/theconversation.com\/trump-slammed-by-musicians-for-appropriating-music-but-pop-and-politics-have-a-long-history-63901\">right of publicity<\/a>\u201d, which refers to an artist\u2019s personal brand, like a trademark, and could potentially allow for legal action if this were seen to be degraded by a particular use of their music without permission. While there\u2019s a long history of artists objecting to their music being used by politicians, it has become a <a href=\"https:\/\/www.insider.com\/artists-who-dont-want-trump-using-their-music-2018-11\">torrent around Trump<\/a>. Normally a \u201ccease-and-desist\u201d letter suffices \u2013 and plenty have been sent \u2013 but the president, or his campaign team, seem unconcerned with such niceties.<\/p>\n<p>Joe Biden has enjoyed a rather more cooperative relationship with the musical world. Bruce Springsteen has long made a habit of appearing on the stump for Democrat candidates. This time around he has also authorised the use of his song <a href=\"https:\/\/twitter.com\/springsteen\/status\/1322582291453861890\">My Hometown<\/a> for a Biden ad, which the singer also narrates, centred on Scranton, Pennsylvania where the candidate grew up.<\/p>\n<figure><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/KExE6wL_GFM?wmode=transparent&amp;start=0\" width=\"440\" height=\"260\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/figure>\n<p>Similarly, the Beastie Boys departed from their <a href=\"https:\/\/www.adweek.com\/agencies\/in-a-rarity-for-the-beastie-boys-the-band-licenses-a-song-for-an-ad-in-support-of-joe-biden\/\">usual refusal to license their work for adverts<\/a> by allowing the use of Sabotage in a piece featuring an embattled music venue to highlight the shortcomings of Trump\u2019s response to the COVID-19 pandemic. In an indication of just how tense this election is, though, <a href=\"https:\/\/www.metrotimes.com\/news-hits\/archives\/2020\/10\/22\/joe-bidens-blind-pig-ad-removed-due-to-threats-against-club-owner\">the ad was pulled<\/a> after the owner of the venue started receiving threats.<\/p>\n<h2>Comparatively harmonious<\/h2>\n<p>The Biden-Harris campaign also appears to have taken a more strategic and considered approach to its use of music. Trump\u2019s use of music leans heavily on broad-brush patriotism and on the few musical endorsements he\u2019s received \u2013 such as country artist Lee Greenwood, whose God Bless America has been a <a href=\"https:\/\/thehill.com\/homenews\/administration\/468573-trump-taps-god-bless-the-usa-singer-lee-greenwood-for-kennedy-center\">longstanding Trump theme<\/a>.<\/p>\n<figure><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/4kCidgetey8?wmode=transparent&amp;start=0\" width=\"440\" height=\"260\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/figure>\n<p>Trump\u2019s fondness for mass rallies also militates towards songs with a broadly singalong, feelgood vibe that will resonate with, and keep occupied, the older voters who may wait for hours at venues before his appearances. It\u2019s also hard to avoid the conclusion that there\u2019s an element of trolling his critics with the persistent use of the Stones\u2019 classic, You Can\u2019t Always Get What You Want.<\/p>\n<p>Biden\u2019s musical backdrop, on the other hand, feels more carefully calibrated. A New York Times analysis <a href=\"https:\/\/www.nytimes.com\/interactive\/2019\/08\/19\/us\/politics\/presidential-campaign-songs-playlists.html\">during the primaries<\/a> showed that there was an almost even split between black and white artists in his playlists, for instance. His use of Springsteen\u2019s blue-collar aesthetic explicitly echoes the narrative of support for the working and middle classes at the core of his campaign, and his projection of himself as, <a href=\"https:\/\/www.politico.com\/story\/2008\/08\/sen-joe-biden-d-scranton-012955\">in the words of Barack Obama<\/a>, the \u201cscrappy kid from Scranton\u201d.<\/p>\n<p>The greater presence of modern pop in his playlists, in comparison to Trump\u2019s rock classics, speaks to an attempt to reach young voters. Campaign song The Change, by R&amp;B artist JoJo, was only released in October and the advertisement featuring it also deploys a <a href=\"https:\/\/variety.com\/2020\/music\/news\/jojo-change-joe-biden-kamala-harris-presidential-campaign-ad-1234819664\/\">Spanish-language version of the song<\/a>.<\/p>\n<p>Even his use of older songs, like Stevie Wonder\u2019s Higher Ground, appears designed to specifically resonate with his campaign message. The Staples\u2019 Singers <a href=\"https:\/\/www.youtube.com\/watch?v=m01H7TvUL_I\">We The People<\/a>, for example, explicitly echoes the US constitution, the protection of which in the face of Trumpian assaults has been a core plank of Biden\u2019s narrative.<\/p>\n<p>Given the febrile nature of the past four years, many would welcome a change of tune. But it\u2019s unlikely that any defeat would silence Trump. Ultimately, though, only one set of supporters will be singing when the results come in. <a href=\"https:\/\/projects.fivethirtyeight.com\/2020-election-forecast\/\">The polling indicates<\/a> that this will be Biden\u2019s, although the experience of 2016 means that nothing is to be taken for granted.<!-- Below is The Conversation's page counter tag.
