Their&nbsp;words and actions have accomplished much to protect them from unknowingly funding the Chinese military or the Chinese Communist Party\u2019s <a href=\"https:\/\/thehill.com\/opinion\/international\/507856-us-businesses-must-take-a-stand-against-chinas-human-rights-abuses\">human rights abuses<\/a>. Krach <a href=\"https:\/\/www.state.gov\/under-secretary-keith-krachs-remarks-to-the-press-on-communist-chinese-military-companies\/\">believes<\/a> that \u201cmost Americans have no idea that their own money\u2014held in pension funds, 401Ks, and brokerage accounts\u2014is financing Chinese companies that support the People\u2019s Republic of China\u2019s (PRC\u2019s) military, security, and intelligence apparatus, as well as human rights abuses on an epic scale, such as those in Xinjiang. Citizens, institutions, and companies must be made aware that the CCP\u2019s large-scale human rights abuses, which include forced abortion, forced sterilization, abuse of women, forced marriage, and forced labor, result in cultural and religious genocide.\u201d \u201cWe are holding China accountable,&#8221; Krach <a href=\"https:\/\/www.newsmax.com\/us\/krach-state-china-communists\/2020\/07\/16\/id\/977569\/\">told<\/a> Fox Business&#8217; Maria Bartiromo. &#8220;They&#8217;ve attacked in Hong Kong freedoms of the press, freedom of speech, freedom of assembly, and rule of law.&#8221; He followed up with an op-ed titled \u201cUS businesses must take a stand against China&#8217;s human rights abuses.\u201d<\/p>\n<p>However, Krach and his team didn\u2019t bring their&nbsp;legendary <a href=\"https:\/\/www.lifeandnews.com\/articles\/life-and-news-names-keith-krach-2018-transformational-leader-of-the-year\/\">transformational leadership<\/a> skills from Silicon Valley to DC to write op-eds and make TV appearances. Instead, he masterminded the Clean Network to address the long-term threat to security and human rights posed by the CCP. Krach&#8217;s <a href=\"https:\/\/www.wsj.com\/articles\/state-department-urges-universities-to-disclose-china-stocks-held-in-index-funds-11598015636\">warning<\/a> to the governing boards of higher education institutions extended to guidance regarding risk reduction due to China&#8217;s financial practices. He <a href=\"https:\/\/www.pionline.com\/endowments-and-foundations\/us-official-tells-endowments-divest-chinese-stocks\">advised<\/a>, \u201cDivesting would be prudent in the likely outcome that enhanced listing standards lead to a wholesale delisting of PRC firms from U.S. exchanges by the end of next year. Holding these stocks also runs the <a href=\"https:\/\/www.theepochtimes.com\/mkt_app\/the-administration-urges-us-colleges-to-divest-chinese-holdings_3469542.html\">high risks<\/a> associated with PRC companies having to restate financials.&#8221; He also <a href=\"https:\/\/www.bloombergquint.com\/business\/state-department-urges-colleges-to-divest-from-chinese-companies\">urged<\/a> them to consider publicly disclosing all Chinese company holdings to their campus communities, &#8220;especially the PRC companies in emerging markets index funds.&#8221;<\/p>\n<table style=\"width: 90%; float: center; margin-left: 25px; margin-right: 25px; border: 1px solid; padding: 10px; box-shadow: 5px 10px 18px #00008B;\">\n<tbody>\n<tr>\n<td><span style=\"font-size: 16px; font-style: italic;\">Krach told the endowment boards that they &#8220;have a moral obligation, and perhaps even a fiduciary duty, to ensure that your institution has clean investments and clean endowment funds.&#8221;<br \/>\n<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>&nbsp;<\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 20px;\"><b><i>Informing Pension Holders<\/i><\/b><\/span><br \/>\nOn December 8, 2020, Krach <a href=\"https:\/\/www.state.gov\/u-s-investors-are-funding-malign-prc-companies-on-major-indices\/\">issued<\/a> a U.S. Department of State fact sheet titled \u201cUS Investors Are Funding Malign PRC Companies on Major Indices,\u201d which listed 13 PRC firms on the\u202f <a href=\"https:\/\/www.bis.doc.gov\/index.php\/policy-guidance\/lists-of-parties-of-concern\/entity-list\">Commerce Department\u2019s Entity List<\/a>, 35 parent-level Communist Chinese Military Companies (CCMCs), and 71 affiliates on the <a href=\"https:\/\/www.defense.gov\/Newsroom\/Releases\/Release\/Article\/2434513\/dod-releases-list-of-additional-companies-in-accordance-with-section-1237-of-fy\/#_blank\">\u202fDepartment of Defense\u2019s List\u202fof CCMCs<\/a> that are included in MSCI, FTSE and Bloomberg emerging market index funds.<\/p>\n<figure id=\"attachment_23855\" aria-describedby=\"caption-attachment-23855\" style=\"width: 400px\" class=\"wp-caption alignright\"><img loading=\"lazy\" class=\"wp-image-23855\" src=\"https:\/\/www.lifeandnews.com\/articles\/wp-content\/uploads\/Krach_Investor_Human_Rights_Picture6-443x290.png\" alt=\"Krach_Investor_Human_Rights_Picture6\" width=\"400\" height=\"262\" srcset=\"https:\/\/www.lifeandnews.com\/articles\/wp-content\/uploads\/Krach_Investor_Human_Rights_Picture6-443x290.png 443w, https:\/\/www.lifeandnews.com\/articles\/wp-content\/uploads\/Krach_Investor_Human_Rights_Picture6-198x130.png 198w, https:\/\/www.lifeandnews.com\/articles\/wp-content\/uploads\/Krach_Investor_Human_Rights_Picture6.png 568w\" sizes=\"(max-width: 400px) 100vw, 400px\" \/><figcaption id=\"caption-attachment-23855\" class=\"wp-caption-text\">Figure 1 &#8211; While the recent decisions by index providers to remove several Chinese companies are welcoming, those firms \u201care the tip of an iceberg of more than 1,000 subsidiary companies,\u201d Keith Krach, undersecretary of state said in his prepared remarks to the press on Jan. 14.<\/figcaption><\/figure>\n<p>These malign PRC companies are being financed with the help of the $10.7 trillion invested in more than 5,000 U.S. pension systems <a href=\"https:\/\/www.theepochtimes.com\/mkt_app\/trump-administration-strengthens-order-banning-us-investment-in-chinese-military-companies_3635625.html\">through the use<\/a> of emerging market index funds. This includes all 401k\u2019s of the 10 largest U.S. companies; all 10 of the top federal contractors; all 20 of the largest state pension plans; All six of the largest target-date mutual-fund providers; and the Pension Benefit Guaranty Corporation with $131 billion in pension insurance reserves.&nbsp;Kinsey said, \u201c MSCI and FTSE Index Funds are racing against the clock to divest over 50 Chinese stocks before prices drop.\u201d<\/p>\n<p>Kinsey&nbsp;emphasized that these Chinese companies are engaging in activities contrary to the national security and foreign policy interests of the United States, which includes supporting PRC military development, human rights abuse in Xinjiang, surveillance violations, and helping the Chinese military construct and militarize the South China Sea.<\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 20px;\"><b><i>Forewarning Stock Exchange Delistings<\/i><\/b><\/span><br \/>\nKrach\u2019s December 8th <a href=\"https:\/\/www.state.gov\/u-s-investors-are-funding-malign-prc-companies-on-major-indices\/\">fact sheet<\/a> highlighted that CCMCs, China Mobile Ltd., China Telecom Corp. and China Unicom Hong Kong Ltd. are on the New York Stock Exchange and warned investors that these Chinese company\u2019s stocks have increased risk due to being subject to sanctions, public protests, trade restrictions, boycotts, delisting and other punitive measures that jeopardize their business and profitability. On January 7, 2021, The New York Stock Exchange announced the delisting of the three major Chinese telecommunications firms. China Telecom Corp. shares dropped 9.4% and China Mobile Ltd. fell 7.2%, closing at their lowest prices since 2008 and 2006 respectively. Krach stressed that <a href=\"https:\/\/www.theepochtimes.com\/trump-administration-accelerating-financial-decoupling-with-china-experts_3580237.html\">ample notice<\/a> had been given to compliance officers and risk managers about disclosing the material risk\u202fto their constituents. Krach and Kinsey also warned CEOs and their boards about their\u202flegal duty to be in full\u202fcompliance and take decisive action to minimize any negative effect\u202fon their\u202fclients\u2019 holdings due to imminent divestment.<\/p>\n<table style=\"width: 90%; float: center; margin-left: 25px; margin-right: 25px; border: 1px solid; padding: 10px; box-shadow: 5px 10px 18px #00008B;\">\n<tbody>\n<tr>\n<td><span style=\"font-size: 16px; font-style: italic;\">Ample warning has been given to public and private equity compliance officers and risk managers to understand and disclose to their constituents the material risk associated with investments identified in the Executive Order. CEOs and their boards now have a legal duty to implement and be in <span style=\"color: blue;\">full compliance<\/span> with the Executive Order. They also may have a fiduciary duty to take decisive action to minimize any negative effect on their clients&#8217; holdings due to the imminent divestment of CCMCs. He asked journalists to tell American investors to call their fund managers and ask about any CCMC investments in their portfolio to guard against potential losses due to imminent divestment.<\/p>\n<p>During a conference call with reporters on Jan. 14, Krach <a href=\"https:\/\/www.theepochtimes.com\/trump-speeds-ban-on-chinese-stocks-in-final-weeks_3661705.html\">declined to comment<\/a> on the interagency decision process to exclude these tech giants from the Pentagon\u2019s blacklist but claimed there is ample open-source documentation showing these companies are strategic to the Chinese military.<\/p>\n<table style=\"width: 90%; float: center; margin-left: 25px; margin-right: 25px; border: 1px solid; padding: 10px; box-shadow: 5px 10px 18px #00008B;\">\n<tbody>\n<tr>\n<td><span style=\"font-size: 16px; font-style: italic;\">Please tell American citizens who are investors and pension holders that their fund manager should notify you if your investments are contributing to the Chinese Party&#8217;s military buildup, the surveillance state, and human rights abuses.
