Marsh<\/a>, <em><a href=\"https:\/\/theconversation.com\/institutions\/wake-forest-university-1709\">Wake Forest University<\/a><\/em><\/p>\n\n\n\n<p>The public furor continues over Donald Trump\u2019s behavior during a <a href=\"https:\/\/www.nytimes.com\/2024\/09\/01\/us\/politics\/trump-arlington-cemetery-army.html\">visit to Arlington National Cemetery<\/a> on Aug. 26, 2024.<\/p>\n\n\n\n<p>Since that visit to the U.S. military burial ground outside Washington, D.C., <a href=\"https:\/\/www.politico.com\/news\/magazine\/2024\/09\/03\/5-things-trump-arlington-cemetery-00177067\">news reports<\/a> and campaign photos have emerged showing the former president grinning widely and giving a \u201cthumbs-up\u201d gesture while standing behind the grave of an American serviceman <a href=\"https:\/\/www.defense.gov\/News\/News-Stories\/Article\/article\/3741245\/kabul-airport-attack-review-reaffirms-initial-findings-identifies-attacker\/\">killed during the 2021 U.S. evacuation from Afghanistan<\/a>. Visible in those images, too, are the graves of two U.S. Army Green Berets.<\/p>\n\n\n\n<p>The Trump campaign later released video showing images of him in Arlington National Cemetery <a href=\"https:\/\/www.thedailybeast.com\/trump-posts-tiktok-from-controversial-visit-to-arlington-national-cemetery\">with audio criticizing the Biden administration<\/a> for its handling of the withdrawal from Afghanistan.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img src=\"https:\/\/images.theconversation.com\/files\/617629\/original\/file-20240905-18-w657pm.jpg?ixlib=rb-4.1.0&amp;q=45&amp;auto=format&amp;w=237&amp;fit=clip\" alt=\"A sign reads 'Welcome to Arlington National Cemetery, our nation's most sacred shrine. Please remember these are hallowed grounds.'\"\/><figcaption>Signs like this greet visitors to Arlington National Cemetery. <a href=\"https:\/\/www.gettyimages.com\/detail\/news-photo\/view-of-the-welcome-sign-for-visitors-to-arlington-national-news-photo\/612537070\">Mark Reinstein\/Corbis via Getty Images<\/a><\/figcaption><\/figure>\n\n\n\n<p>Trump\u2019s politicking and seemingly cavalier demeanor at a site marked by signs declaring itself \u201cAmerica\u2019s most sacred shrine\u201d have spurred many <a href=\"https:\/\/www.salon.com\/2024\/09\/04\/the-point-of-trumps-dishonor-why-the-arlington-debacle-is-about-more-than-the-fallen\/\">critical commentaries in the media<\/a>, including from <a href=\"https:\/\/www.washingtonpost.com\/opinions\/2024\/09\/04\/mullen-arlington-politics-trump-afghanistan\/\">former military leaders<\/a>.<\/p>\n\n\n\n<p>For his part, Trump <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/113074142531291102\">complained on Truth Social<\/a> on Sept. 3, 2024, that reports of the incident were a \u201cmade up story by Comrade Kamala and her misinformation squad.\u201d His campaign staff says it had permission from the family of one soldier buried at Arlington <a href=\"https:\/\/www.cbsnews.com\/news\/gold-star-families-trump-arlington-cemetery-harris-response\/\">to take photos and video<\/a> in the cemetery.<\/p>\n\n\n\n<p>But as a legal scholar <a href=\"https:\/\/scholar.google.com\/citations?user=HdP043EAAAAJ&amp;hl=en&amp;oi=ao\">specializing in cemetery law<\/a>, I know that their permission is irrelevant. They are not cemetery officials. The law allows cemeteries to make their own rules.<\/p>\n\n\n\n<p>And Arlington National Cemetery has, by far, the strictest rules of any cemetery in the United States. It is clear to me that the actions of Trump and his campaign staff were outside the rules of a place that orders visitors to \u201cconduct yourselves with dignity and respect at all times.\u201d<\/p>\n\n\n\n<h2>A unique legal situation \u2013 and a unique cemetery<\/h2>\n\n\n\n<p>Arlington National Cemetery, where <a href=\"https:\/\/www.arlingtoncemetery.mil\/Explore\/History-of-Arlington-National-Cemetery\">over 400,000 U.S. service members and relatives<\/a> have been buried since 1864, is one of <a href=\"https:\/\/www.cem.va.gov\/\">164 national cemeteries<\/a> established by Congress and administered by the federal government. These cemeteries were <a href=\"https:\/\/www.nps.gov\/articles\/000\/national-cemeteries-history.htm\">first created in 1862<\/a>, during the Civil War.<\/p>\n\n\n\n<p>Most of the cemeteries have since been transferred to the <a href=\"https:\/\/www.cem.va.gov\/facts\/NCA_History_and_Development_1.asp\">Department of Veterans Affairs<\/a> or <a href=\"https:\/\/www.nps.gov\/articles\/nationalparks-nationalcemeteries.htm\">National Park Service<\/a>, but Arlington National Cemetery remains <a href=\"https:\/\/www.ecfr.gov\/current\/title-32\/subtitle-A\/chapter-V\/subchapter-D\/part-553\/subpart-A\/section-553.1\">under the control of the Department of the Army<\/a>.<\/p>\n\n\n\n<p>Arlington is no ordinary cemetery. Federal law says it is \u201c<a href=\"https:\/\/www.ecfr.gov\/current\/title-32\/subtitle-A\/chapter-V\/subchapter-D\/part-553\/subpart-A\/section-553.33\">a national shrine to the honored dead of the Armed Forces<\/a>.\u201d Therefore, the law says, \u201ccertain acts and activities, which may be appropriate elsewhere, are not appropriate\u201d at Arlington.<\/p>\n\n\n\n<p>In general, cemetery owners \u2013 religious organizations, local governments, nonprofits, for-profits and families \u2013 decide who may be interred on their land, the size and configuration of burial plots and the rights of plot owners. Cemeteries are permitted to define a visitor code of conduct and regulate what activities can take place at the cemetery.<\/p>\n\n\n\n<p>These rules supersede the wishes of the family members of those interred in a cemetery. For example, cemeteries may prohibit families from placing plastic flowers on a grave, or require headstones to be in specific shapes or sizes.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img src=\"https:\/\/images.theconversation.com\/files\/617602\/original\/file-20240905-18-wgq4mw.jpg?ixlib=rb-4.1.0&amp;q=45&amp;auto=format&amp;w=754&amp;fit=clip\" alt=\"\"\/><figcaption>One of the photos Donald Trump\u2019s campaign shared of his visit to Arlington National Cemetery on Aug. 26, 2024. <a href=\"https:\/\/x.com\/GovCox\/status\/1828089276359414118\">X.com\/GovCox<\/a><\/figcaption><\/figure>\n\n\n\n<h2>A quick recap of events<\/h2>\n\n\n\n<p>Trump went to Arlington National Cemetery at the invitation of members of the <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/113037529550199315\">families of two U.S. Marines<\/a> killed in a bombing at the Kabul airport on Aug. 26, 2021.<\/p>\n\n\n\n<p>After presenting a wreath at the <a href=\"https:\/\/www.arlingtoncemetery.mil\/Explore\/Monuments-and-Memorials\/Tomb-of-the-Unknown-Soldier\">Tomb of the Unknown Soldier<\/a>, which honors the nation\u2019s war dead, Trump and his campaign staff visited the grave of at least one of those slain Marines, accompanied by members of the Marine\u2019s family.<\/p>\n\n\n\n<p>As Trump\u2019s campaign staff took photos and video of Trump and the others standing among the graves, a cemetery employee approached to explain that political activity is prohibited at Arlington. A Trump campaign staffer allegedly ignored the warning and \u201c<a href=\"https:\/\/www.npr.org\/2024\/08\/27\/nx-s1-5091154\/trump-arlington-cemetery\">verbally abused and pushed the official aside<\/a>,\u201d according to NPR.<\/p>\n\n\n\n<p>The cemetery employee <a href=\"https:\/\/www.vox.com\/2024-elections\/369711\/trump-arlington-cemetery-controversy-army\">reported the encounter to military police<\/a> but declined to press charges \u2013 reportedly for <a href=\"https:\/\/www.npr.org\/2024\/09\/03\/g-s1-20680\/trump-arlington-cemetery\">fear of being harassed by Trump supporters<\/a>.<\/p>\n\n\n\n<p>The next day, the Army itself took the unusual step of issuing a <a href=\"https:\/\/www.cnn.com\/2024\/08\/29\/politics\/us-army-rebukes-trump-campaign-arlington-incident\/index.html\">formal statement rebuking a public figure<\/a> for inappropriate behavior in one of its cemeteries.<\/p>\n\n\n\n<p>\u201c<a href=\"https:\/\/www.npr.org\/2024\/08\/27\/nx-s1-5091154\/trump-arlington-cemetery\">Federal law prohibits political campaign<\/a> or election-related activities within Army National Military Cemeteries,\u201d the Aug. 27 statement said, \u201cto include photographers, content creators or any other persons attending for purposes, or in direct support of a partisan political candidate\u2019s campaign.\u201d<\/p>\n\n\n\n<h2>Arlington\u2019s rules<\/h2>\n\n\n\n<p>Many modern cemeteries permit all kinds of activities, even <a href=\"https:\/\/historicelmwoodpinewood.org\/drop-dead-5k\">hosting running races<\/a> or <a href=\"https:\/\/hollywoodforever.com\/culture\/\">movie nights<\/a>.<\/p>\n\n\n\n<p>Not Arlington.<\/p>\n\n\n\n<p>Its rules bar running, cycling, picnicking and animals other than service animals or military working dogs. \u201cDisrespectful and disorderly\u201d conduct is specifically prohibited at Arlington, and all visitors \u201cshall observe proper standards of decorum and decency\u201d while in the cemetery. The rules also bar \u201c<a href=\"https:\/\/www.ecfr.gov\/current\/title-32\/subtitle-A\/chapter-V\/subchapter-D\/part-553\/subpart-A\/section-553.32\">partisan political activities<\/a>.\u201d<\/p>\n\n\n\n<p>In general, the <a href=\"https:\/\/www.arlingtoncemetery.mil\/Media\/Photo-Use-Policy\">public may take photos<\/a> at Arlington, as may the media, with <a href=\"https:\/\/www.arlingtoncemetery.mil\/Media\/Media-Policy\">prior authorization and an escort<\/a>. As of at least April 2022, however, no one may film in the cemetery for \u201c<a href=\"https:\/\/www.arlingtoncemetery.mil\/Portals\/0\/ANC-media-policy.pdf\">partisan, political or fundraising purposes<\/a>\u201d \u2013 which is precisely what Trump appears to have done.<\/p>\n\n\n\n<p>His team violated another rule, too \u2013 one stating that headstones may not be filmed without written authorization from the deceased\u2019s next of kin. Trump\u2019s campaign apparently received permission from at least one family to film their relative\u2019s headstone, but it <a href=\"https:\/\/www.nytimes.com\/2024\/08\/28\/us\/politics\/trump-arlington-cemetery.html\">did not get permission from the families<\/a> associated with all the headstones visible in the footage.<\/p>\n\n\n\n<h2>Penalties<\/h2>\n\n\n\n<p>The rules governing visitors at Arlington National Cemetery are not criminal laws. Violating them cannot result in jail time or even a fine. Instead, the cemetery\u2019s executive director <a href=\"https:\/\/www.ecfr.gov\/current\/title-32\/subtitle-A\/chapter-V\/subchapter-D\/part-553\/subpart-A\/section-553.5\">has the authority<\/a> to remove violators from the cemetery and bar them from returning. The Army has said it \u201c<a href=\"https:\/\/www.npr.org\/2024\/08\/29\/nx-s1-5092087\/trump-arlington-cemetery-altercation-video\">considers the matter closed<\/a>\u201d and has not said whether anyone has been told not to return to the cemetery.<\/p>\n\n\n\n<p><a href=\"https:\/\/theconversation.com\/profiles\/tanya-d-marsh-366761\">Tanya D.
