Environmental Protection Agency<\/a> on Oct. 16, 2024. This case <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-753\/290765\/20240108152337022_2024-01-08%20SF%20Petition%20for%20Writ%20of%20Certiorari.pdf\">asks the court<\/a> to decide whether federal regulators can issue permits that are effectively broad orders not to violate water quality standards, or instead may only specify the concentrations of individual pollutants that permit holders can release into water bodies.<\/p>\n\n\n\n<p>My research <a href=\"https:\/\/scholar.google.com\/citations?user=WbA91Y8AAAAJ&amp;hl=en\">focuses on water issues<\/a>, including the Clean Water Act. This case involves both federal and state authority to issuing permits, and it will be interesting to see where the court focuses. While justices have been willing to limit the EPA\u2019s authority under the act, they traditionally have allowed states broad authority to <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/511\/700\/#tab-opinion-1959519\">protect water quality<\/a>. Thus, while some fear that this case is yet another occasion for the court to limit the EPA\u2019s authority, California\u2019s involvement may have exactly the opposite effect.<\/p>\n\n\n\n<h2>Standards for treating sewage<\/h2>\n\n\n\n<p>The <a href=\"https:\/\/www.epa.gov\/laws-regulations\/history-clean-water-act\">1972 Clean Water Act<\/a> prohibits any \u201c<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/33\/1311\">discharge of a pollutant<\/a>\u201d without a permit into water bodies such as rivers, lakes and bays that are <a href=\"https:\/\/www.epa.gov\/wotus\/current-implementation-waters-united-states\">subject to federal regulation<\/a>. San Francisco has a combined sewage treatment plant and stormwater control system, <a href=\"https:\/\/www.sfpuc.gov\/about-us\/our-systems\/sewer-system\/treating-liquid-flows\">the Oceanside plant<\/a>, which discharges treated sewage and stormwater into the Pacific Ocean through eight pipes, or \u201coutfalls.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img src=\"https:\/\/images.theconversation.com\/files\/624389\/original\/file-20241008-15-o8cj6b.jpeg?ixlib=rb-4.1.0&amp;q=45&amp;auto=format&amp;w=237&amp;fit=clip\" alt=\"Vehicle entrance to a low-slung concrete building marked 'Oceanside Water Pollution Control Plant'\"\/><figcaption>San Francisco\u2019s Oceanside water treatment plant is built into a hollowed-out hill in the southwest corner of the city and discharges to the Pacific Ocean. <a href=\"https:\/\/en.wikipedia.org\/wiki\/Oceanside_Water_Pollution_Control_Plant\">Pi.1415926535\/Wikimedia<\/a>, <a href=\"http:\/\/creativecommons.org\/licenses\/by-sa\/4.0\/\">CC BY-SA<\/a><\/figcaption><\/figure>\n\n\n\n<p>The California <a href=\"https:\/\/www.waterboards.ca.gov\/water_issues\/programs\/npdes\/\">State Water Resources Control Board<\/a> is in charge of seven outfalls that release treated water close to shore, in state waters. But the facility\u2019s main pipe discharges in federal waters more than 3 miles out to sea, so it is regulated by the EPA.<\/p>\n\n\n\n<p>To comply with the law, polluters must obtain permits through the <a href=\"https:\/\/www.epa.gov\/npdes\/npdes-permit-basics\">National Pollutant Discharge Elimination System<\/a>. The city and county of San Francisco have held a permit for the Oceanside facility since 1997.<\/p>\n\n\n\n<p>Discharge permit requirements can be both quantitative and qualitative. For example, the EPA establishes standard <a href=\"https:\/\/www.epa.gov\/npdes\/npdes-permit-limits\">effluent limitations<\/a> that dictate how clean the discharger\u2019s waste stream must be. The agency sets these <a href=\"https:\/\/www3.epa.gov\/npdes\/pubs\/chapt_05.pdf\">technology-based limitations<\/a> according to the methods available in the relevant industry to clean up polluted wastewater.<\/p>\n\n\n\n<p>Numeric targets tell the discharger clearly how to comply with the law. For example, sewage treatment plants must keep the <a href=\"https:\/\/www.epa.gov\/goldkingmine\/what-ph\">pH value<\/a> of their wastewater discharges between 6.0 and 9.0. This can happen after the city\u2019s water treatment system is overwhelmed during major storms. <a href=\"https:\/\/www.sfpuc.gov\/programs\/ocean-and-beach-monitoring\">San Francisco Public Utilities Commission<\/a><\/figcaption><\/figure>\n\n\n\n<h2>What counts as \u2018clean\u2019?<\/h2>\n\n\n\n<p>A second approach focuses not on the specific content of the discharge but rather on setting standards for <a href=\"https:\/\/www.epa.gov\/wqs-tech\">what counts as a \u201cclean\u201d water body<\/a>.<\/p>\n\n\n\n<p>Under the Clean Water Act, Congress gives states authority to establish water quality standards for each water body within their territory. First, the state <a href=\"https:\/\/www.epa.gov\/wqs-tech\/designated-uses\">identifies the uses<\/a> it wants the ocean, river, lake or bay to support, such as swimming, providing habitat for fish or supplying drinking water.<\/p>\n\n\n\n<p>Next, state regulators determine what characteristics the water has to have to support those uses. For example, to support cold-water fish such as perch and pike, the water may need to remain below a certain temperature. These characteristics become the <a href=\"https:\/\/www.epa.gov\/wqc\">water quality criteria<\/a> for that water body.<\/p>\n\n\n\n<p>Sometimes technology-based effluent limitations in a polluter\u2019s permit aren\u2019t stringent enough to ensure that a water body meets its water quality standards. When that happens, the Clean Water Act <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/33\/1312\">requires the permitting agency<\/a> to adjust its permit requirements to ensure that water quality standards are met.<\/p>\n\n\n\n<p>That\u2019s what happened with the Oceanside plant. During rainstorms, runoff sometimes overwhelms the plant\u2019s sewage treatment system, dumping a mixture of sewage and storm runoff directly into the Pacific Ocean \u2013 an event known as a <a href=\"https:\/\/www.epa.gov\/npdes\/combined-sewer-overflow-basics\">combined sewer overflow<\/a>. These episodes can cause violations of water quality standards. Area beaches sometimes are closed to swimming when bacterial counts in the water are high.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img src=\"https:\/\/images.theconversation.com\/files\/624399\/original\/file-20241008-25-uvonk6.png?ixlib=rb-4.1.0&amp;q=45&amp;auto=format&amp;w=754&amp;fit=clip\" alt=\"Graphic of a combined sewer system\"\/><figcaption>In combined sewer systems, during dry weather and small storms, all flows are handled by the publicly owned treatment works. In a separate legal action, the federal government and the state of California <a href=\"https:\/\/www.epa.gov\/newsreleases\/united-states-and-california-take-enforcement-action-against-san-francisco-violations\">are suing San Francisco<\/a> for discharging more than 1.8 billion gallons of sewage on average every year since 2016 into creeks, San Francisco Bay and the Pacific Ocean.<\/p>\n\n\n\n<p>The complaint asserts that San Francisco has not significantly upgraded its combined sewer overflow system in the past 25 years, and that the system is failing to meet standards in the city\u2019s and county\u2019s Clean Water Act permits.<\/p>\n\n\n\n<p>When the EPA and California issued the Oceanside plant\u2019s current permit in 2019, they included two general standards. The first requires that Oceanside\u2019s \u201c[d]ischarge shall not cause or contribute to a violation of any applicable water quality standard.\u201d The second states that \u201c[n]either the treatment nor the discharge of pollutants shall create pollution, contamination, or nuisance\u201d as defined under California law.<\/p>\n\n\n\n<p>The city and county of San Francisco argue that their permit terms aren\u2019t fair because they can\u2019t tell how to comply. Their petition to the court asserts that Clean Water Act permits should function like recipes that restrict specific ingredients in a dish, rather than telling cooks <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-753\/319475\/20240719164138682_23-753%20Brief%20of%20Petitioner.pdf\">not to make the dish \u201ctoo salty<\/a>.\u201d<\/p>\n\n\n\n<p>The Supreme Court will decide whether such narrative permit terms are legal. https:\/\/www.youtube.com\/embed\/UBhmfP_AzIM?wmode=transparent&amp;start=0 The Environmental Protection Agency and California water officials are suing San Francisco, accusing the city of allowing its sewer systems to fall into disrepair.<\/p>\n\n\n\n<h2>What\u2019s legal, what\u2019s fair<\/h2>\n\n\n\n<p>In its brief, the EPA invokes <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/33\/1311\">Section 1311(b)(1)(C)<\/a> of the Clean Water Act, which allows permit writers to insert \u201cany more stringent limitation, including those necessary to meet water quality standards,\u201d into the permit. The agency argues that this phrase allows for narrative permit terms \u2013 a position that was upheld by the <a href=\"https:\/\/cdn.ca9.uscourts.gov\/datastore\/opinions\/2023\/07\/31\/21-70282.pdf\">U.S. Court of Appeals for the 9th Circuit<\/a>.<\/p>\n\n\n\n<p>The city and county argue that \u201cany more stringent limitation\u201d still has to be a numeric, end-of-the-pipe requirement. They also contend that the very general requirements in the Oceanside plant\u2019s discharge permit fail to give notice of what\u2019s actually required for compliance, leaving the city vulnerable to penalties and lawsuits.<\/p>\n\n\n\n<p>The key question, then, is how much flexibility regulators and regulated entities get. If state environmental agencies and the EPA have to translate every water quality criterion into a numeric effluent limitation, permit writers could be overwhelmed. Or, as the EPA warns in its brief, they could impose very stringent requirements to ensure that the discharge won\u2019t violate water quality standards.<\/p>\n\n\n\n<p>For example, some sewage treatment plants can and do <a href=\"https:\/\/www.ocwd.com\/what-we-do\/water-reuse\/\">treat sewage to drinking water standards<\/a>. Requiring San Francisco to do this would ensure that discharges from the Oceanside plant did not make waters offshore unusable. It also would make clear how to comply with the law. However, it would require <a href=\"https:\/\/www.ocwd.com\/wp-content\/uploads\/white-paper-cost-of-gwrs.pdf\">expensive upgrades<\/a> to the plant.<\/p>\n\n\n\n<p>It\u2019s unusual to see a liberal, <a href=\"https:\/\/www.sfenvironment.org\/\">pro-environment city<\/a> such as San Francisco challenge the EPA, with support from <a href=\"https:\/\/www.eenews.net\/articles\/strange-bedfellows-align-in-latest-supreme-court-water-case\/\">trade groups such as the National Mining Association<\/a> that also see the EPA\u2019s approach as too vague. Conversely, all 14 states that joined one of the two state amicus briefs filed in this case are on the agency\u2019s side \u2013 a sign that state environmental regulators want flexibility in setting targets for polluters.<\/p>\n\n\n\n<p>If the justices are content to merely interpret what Congress meant by allowing \u201cany more stringent limitation\u201d in permits, then the EPA has the stronger case. If they focus on fairness, however, San Francisco has a good argument \u2013 especially before a court that has already <a href=\"https:\/\/theconversation.com\/the-supreme-court-just-shriveled-federal-protection-for-wetlands-leaving-many-of-these-valuable-ecosystems-at-risk-205896\">issued multiple decisions<\/a> <a href=\"https:\/\/theconversation.com\/whats-next-after-supreme-court-curbs-regulatory-power-more-focus-on-laws-wording-less-on-their-goals-232938\">curbing federal regulatory power<\/a>.<\/p>\n\n\n\n<p><a href=\"https:\/\/theconversation.com\/profiles\/robin-kundis-craig-1338308\">Robin Kundis Craig<\/a>, Professor of Law, <em><a href=\"https:\/\/theconversation.com\/institutions\/university-of-kansas-1588\">University of Kansas<\/a><\/em><\/p>\n\n\n\n<p>This article is republished from <a href=\"https:\/\/theconversation.com\">The Conversation<\/a> under a Creative Commons license.
