Christopher Frey<\/a>, <em><a href=\"https:\/\/theconversation.com\/institutions\/north-carolina-state-university-1894\">North Carolina State University<\/a><\/em><\/p>\n\n\n\n<p>Science is essential as the U.S. Environmental Protection Agency carries out <a href=\"https:\/\/www.epa.gov\/aboutepa\/our-mission-and-what-we-do\">its mission<\/a> to protect human health and the environment.<\/p>\n\n\n\n<p>In fact, <a href=\"https:\/\/www.epa.gov\/laws-regulations\/laws-and-executive-orders#majorlaws\">laws passed by Congress<\/a> require the EPA to use the \u201cbest available science\u201d <a href=\"https:\/\/www.epa.gov\/system\/files\/documents\/2022-03\/fy-2022-2026-epa-strategic-plan.pdf\">in many decisions<\/a> about regulations, permits, cleaning up contaminated sites and responding to emergencies.<\/p>\n\n\n\n<p>For example, the <a href=\"https:\/\/www.epa.gov\/clean-air-act-overview\/clean-air-act-solving-air-pollution-problems-science-and-technology\">Clean Air Act<\/a> requires the EPA to rely on science for setting emission standards and health-based air quality standards. The <a href=\"https:\/\/www.congress.gov\/crs-product\/R46652\">Safe Drinking Water Act<\/a> requires the EPA to consider the best available peer-reviewed science when setting health-based standards. The <a href=\"https:\/\/www.epa.gov\/wqc\">Clean Water Act<\/a> requires the agency to develop surface water quality criteria that reflect the latest science. The <a href=\"https:\/\/www.epa.gov\/assessing-and-managing-chemicals-under-tsca\/risk-evaluations-existing-chemicals-under-tsca\">Toxic Substances Control Act<\/a> requires the EPA to use the best available science to assess risk of chemicals to human health and the environment.<\/p>\n\n\n\n<p>But what exactly does \u201cbest available science\u201d mean?<\/p>\n\n\n\n<p>That\u2019s an important question as the Trump administration launches an <a href=\"https:\/\/www.epa.gov\/newsreleases\/epa-launches-biggest-deregulatory-action-us-history\">effort to roll back<\/a> clean air and water regulations at the same time it is preparing to <a href=\"https:\/\/thehill.com\/policy\/energy-environment\/5116562-trump-administration-dismisses-epa-committees\/\">replace all the members of two crucial EPA science advisory boards<\/a> and considering <a href=\"https:\/\/www.nytimes.com\/2025\/03\/17\/climate\/trump-eliminates-epa-science.html\">eliminating the Office of Research and Development<\/a> \u2013 the scientific research arm of the EPA.<\/p>\n\n\n\n<h2>What is best available science?<\/h2>\n\n\n\n<p>Some basic definitions for best available science can be found in laws, court rulings and other sources, including the EPA\u2019s own policies.<\/p>\n\n\n\n<p>The science must be <a href=\"https:\/\/www.environmentalprotectionnetwork.org\/wp-content\/uploads\/2025\/01\/SecuringScientificIntegrity.EPN_.01172025.final_.docx.pdf\">reliable, unbiased<\/a>, <a href=\"https:\/\/pmc.ncbi.nlm.nih.gov\/articles\/PMC4887529\/\">objective and value-neutral<\/a>, meaning it is not influenced by personal views. Best available science is the result of the <a href=\"https:\/\/doi.org\/10.1007\/s00267-016-0697-z\">scientific process and hypothesis testing by scientists<\/a>. And it is <a href=\"https:\/\/eelp.law.harvard.edu\/dc-circuit-weighs-in-on-epas-science-mandates\/\">based on current knowledge from relevant technical expertise<\/a> and must be credible.<\/p>\n\n\n\n<p>The EPA\u2019s <a href=\"https:\/\/www.epa.gov\/system\/files\/documents\/2025-01\/us-epa-scientific-integrity-policy.pdf\">scientific integrity policy<\/a> includes \u201cprocesses and practices to ensure that the best available science is presented to agency decision-makers and informs the agency\u2019s work.\u201d Those include processes to ensure <a href=\"https:\/\/www.epa.gov\/quality\">data quality<\/a> and <a href=\"https:\/\/www.epa.gov\/sites\/default\/files\/2021-03\/documents\/omb_iqgs.pdf\">information quality<\/a> and procedures for <a href=\"https:\/\/www.epa.gov\/scientific-leadership\/peer-review-handbook-4th-edition-2015\">independent reviews by scientific experts<\/a> outside of government.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img src=\"https:\/\/images.theconversation.com\/files\/659872\/original\/file-20250404-56-44oz2p.jpg?ixlib=rb-4.1.0&amp;q=45&amp;auto=format&amp;w=754&amp;fit=clip\" alt=\"Workers hold a sign reading \"\/><figcaption>Environmental Protection Agency employees and others protest the Trump administration\u2019s actions involving the agency on March 25, 2025, in Philadelphia. <a href=\"https:\/\/newsroom.ap.org\/detail\/TrumpEPAProtests\/da76b55c7f0647f6b6a84c1089244897\/photo\">AP Photo\/Matt Rourke<\/a><\/figcaption><\/figure>\n\n\n\n<p>I have seen the importance of these processes and procedures personally. In addition to being an <a href=\"https:\/\/orcid.org\/0000-0001-9450-0804\">academic researcher<\/a> who works on air pollution, I am a former member of the EPA\u2019s <a href=\"https:\/\/sab.epa.gov\/ords\/sab\/r\/sab_apex\/sab\/home\">Science Advisory Board<\/a>, former chair of the EPA\u2019s <a href=\"https:\/\/casac.epa.gov\/ords\/sab\/r\/sab_apex\/casac\/home\">Clean Air Scientific Advisory Committee<\/a>, and from 2022 to 2024 served as <a href=\"https:\/\/www.aaas.org\/news\/path-senate-confirmation-stpf-alum-chris-frey-head-epas-research-office\">assistant administrator<\/a> of the EPA\u2019s Office of Research and Development and the <a href=\"https:\/\/frey.wordpress.ncsu.edu\/files\/2025\/01\/frey-Jan-2025.pdf\">EPA science adviser<\/a>.<\/p>\n\n\n\n<h2>Advisory boards and in-house research<\/h2>\n\n\n\n<p>The <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/42\/4365\">EPA Science Advisory Board<\/a> plays an important role in ensuring that the EPA uses the best available science. It is tasked with <a href=\"https:\/\/sab.epa.gov\/ords\/sab\/sab_apex\/r\/files\/static\/v403\/Science%20Supporting%20EPA%20Decisions.pdf\">reviewing the scientific and technological basis of EPA actions<\/a>.<\/p>\n\n\n\n<p>The <a href=\"https:\/\/uscode.house.gov\/statutes\/pl\/95\/155.pdf\">1978 Environmental Research, Development, and Demonstration Authorization Act<\/a> ordered EPA to establish the board. The Science Advisory Board\u2019s members must be \u201c<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/42\/4365\">qualified by education, training, and experience<\/a> to evaluate scientific and technical information on matters referred to the Board.\u201d But those members can be replaced by new administrations, as the <a href=\"https:\/\/thehill.com\/policy\/energy-environment\/5116562-trump-administration-dismisses-epa-committees\">Trump administration is planning<\/a> to do now.<\/p>\n\n\n\n<p>During the first Trump administration, the EPA replaced several independent scientists on its advisory boards in a manner that deviated from established practice, according to the <a href=\"https:\/\/www.gao.gov\/assets\/gao-19-280.pdf\">Government Accountability Office<\/a>, and brought in <a href=\"https:\/\/www.science.org\/content\/article\/epa-unveils-new-industry-friendlier-science-advisory-boards\">scientists connected with the industries the EPA regulates<\/a>. I was one of the independent scientists replaced, and I and others <a href=\"https:\/\/theconversation.com\/the-epa-disbanded-our-clean-air-science-panel-we-met-anyway-and-found-that-particle-pollution-regulations-arent-protecting-public-health-125779\">launched an independent review panel<\/a> to continue to deliver expert advice.<\/p>\n\n\n\n<p>No matter who serves on the EPA\u2019s advisory boards, the agency is required by law to follow the best available science. Failing to do so sets the stage for lawsuits.<\/p>\n\n\n\n<p>The same law that established the Science Advisory Board is also a legal basis for the <a href=\"https:\/\/www.congress.gov\/118\/meeting\/house\/116377\/documents\/HHRG-118-SY00-20230927-SD002.pdf\">Office of Research and Development<\/a>, the agency\u2019s scientific research arm and the EPA\u2019s primary source for <a href=\"https:\/\/www.epa.gov\/research\/ord-strategic-goals-and-objectives\">gathering and developing the best available science<\/a> for decision-makers.<\/p>\n\n\n\n<p>During my time at the EPA, the Office of Research and Development\u2019s work informed regulatory decisions involving <a href=\"https:\/\/assessments.epa.gov\/isa\/document\/&amp;deid=359536\">air<\/a>, <a href=\"https:\/\/www.epa.gov\/system\/files\/documents\/2024-04\/final-pfas-mix-framework-3.25.24_final-508.pdf\">water<\/a>, <a href=\"https:\/\/www.epa.gov\/system\/files\/documents\/2024-04\/2024-interim-guidance-on-pfas-destruction-and-disposal.pdf\">land<\/a> and <a href=\"https:\/\/www.epa.gov\/system\/files\/documents\/2021-11\/nams-work-plan_11_15_21_508-tagged.pdf\">chemicals<\/a>. It informed <a href=\"https:\/\/www.epa.gov\/newsreleases\/epa-and-justice-department-file-complaint-alleging-public-health-endangerment-caused\">enforcement actions<\/a>, as well as <a href=\"https:\/\/www.epa.gov\/land-research\">cleanup<\/a> and <a href=\"https:\/\/www.epa.gov\/emergency-response-research\/webinar-series\">emergency response<\/a> efforts in EPA\u2019s regions.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.epa.gov\/research-states\">State agencies<\/a> and <a href=\"https:\/\/www.epa.gov\/tribal-science-council\">tribal nations<\/a> also look to the EPA for expertise on the best available science, since they typically do not have resources to develop this science themselves.<\/p>\n\n\n\n<h2>Federal courts affirm using best available science<\/h2>\n\n\n\n<p>Federal courts have also ordered the EPA to use the best available science, and they have recognized the importance of reviews by external experts.<\/p>\n\n\n\n<p>In 2024, for example, the U.S. Court of Appeals for the District of Columbia Circuit denied an industry petition to review an EPA standard involving ethylene oxide, a pollutant emitted by some chemical and industrial facilities that has been <a href=\"https:\/\/www.cancer.gov\/about-cancer\/causes-prevention\/risk\/substances\/ethylene-oxide\">associated with several types of cancer<\/a>.<\/p>\n\n\n\n<p>The court accorded an \u201c<a href=\"https:\/\/law.justia.com\/cases\/federal\/appellate-courts\/cadc\/23-1045\/23-1045-2024-08-13.html\">extreme degree of deference<\/a>\u201d to the EPA\u2019s evaluation of scientific data within its area of expertise. The court listed key elements of the EPA\u2019s best available science, including \u201can extensive, eighteen-year process that began in 1998, involved rounds of public comment and peer review by EPA\u2019s Science Advisory Board (\u2018SAB\u2019), and concluded in 2016 when EPA issued a comprehensive report on the subject.\u201d<\/p>\n\n\n\n<p>The District of Columbia Circuit in 2013 also affirmed the central role of science to inform revisions of <a href=\"https:\/\/www.epa.gov\/naaqs\">National Ambient Air Quality Standards<\/a>, which set limits for six common air pollutants.<\/p>\n\n\n\n<p>In that case, <a href=\"https:\/\/law.justia.com\/cases\/federal\/appellate-courts\/cadc\/08-1200\/08-1200-2013-07-23.html\">Mississippi v. EPA<\/a>, the court noted that the EPA must receive advice from its <a href=\"https:\/\/casac.epa.gov\/ords\/sab\/r\/sab_apex\/casac\/0?file_id=BHU1XZIXQQ4JW7QWAHYXRNBGVJ99PMO3&amp;request=APPLICATION_PROCESS%3DSHARED_FILE&amp;session=1032076255547\">Clean Air Scientific Advisory Committee<\/a>, or CASAC. The court advised that, while the agency can deviate from the committee\u2019s scientific advice, \u201cEPA must be precise in describing the basis for its disagreement with CASAC.\u201d<\/p>\n\n\n\n<p>The Trump administration in 2025 <a href=\"https:\/\/thehill.com\/policy\/energy-environment\/5116562-trump-administration-dismisses-epa-committees\/\">dismissed<\/a> all members of CASAC and said it planned to replace them.<\/p>\n\n\n\n<h2>What does this all mean?<\/h2>\n\n\n\n<p>Requiring the agency to use the best available science helps ensure that decisions are based on evidence, and that the reasoning behind them is the result of well-accepted scientific processes and free from biases, including <a href=\"https:\/\/doi.org\/10.2105\/ajph.2018.304677\">stakeholder<\/a> or <a href=\"https:\/\/news.bloomberglaw.com\/environment-and-energy\/trump-era-epa-meddled-in-pfas-science-agency-watchdog-finds\">political<\/a> interference.<\/p>\n\n\n\n<p>The scientific challenges facing the EPA are <a href=\"https:\/\/nap.nationalacademies.org\/catalog\/26602\/transforming-epa-science-to-meet-todays-and-tomorrows-challenges\">increasing in complexity<\/a>. Responding to them effectively for the health of the population and the environment requires expertise and robust scientific processes.<\/p>\n\n\n\n<p><a href=\"https:\/\/theconversation.com\/profiles\/h-christopher-frey-586220\">H.
