{"id":8588,"date":"2017-01-03T07:45:01","date_gmt":"2017-01-03T07:45:01","guid":{"rendered":"http:\/\/www.lifeandnews.com\/articles\/?p=8588"},"modified":"2017-01-03T07:45:01","modified_gmt":"2017-01-03T07:45:01","slug":"will-obamas-offshore-drilling-ban-be-trumped","status":"publish","type":"post","link":"https:\/\/www.lifeandnews.com\/articles\/will-obamas-offshore-drilling-ban-be-trumped\/","title":{"rendered":"Will Obama&#8217;s offshore drilling ban be Trumped?"},"content":{"rendered":"<p><span><a href=\"https:\/\/theconversation.com\/profiles\/patrick-parenteau-228749\">Patrick Parenteau<\/a>, <em><a href=\"http:\/\/theconversation.com\/institutions\/vermont-law-school-960\">Vermont Law School<\/a><\/em><\/span><\/p>\n<p>President Obama gave environmental advocates a Christmas present when he announced in late December that he was <a href=\"https:\/\/www.whitehouse.gov\/the-press-office\/2016\/12\/20\/statement-president-actions-arctic-and-atlantic-oceans\">banning oil and gas drilling<\/a> in huge swaths of the Arctic and Atlantic oceans. This action \u201cindefinitely\u201d protects almost 120 million acres of ecologically important and highly sensitive marine environments from the risks of oil spills and other industrial impacts.<\/p>\n<p>President Obama acted boldly to conserve important ecological resources and solidify his environmental legacy. But by making creative use of an obscure provision of a 1953 law, Obama ignited a legal and political firestorm. <\/p>\n<p>Republicans and oil industry trade groups are threatening to challenge the ban in court or through legislation. They also contend that the Trump administration <a href=\"https:\/\/morningconsult.com\/2016\/12\/21\/trump-transition-team-mum-obamas-offshore-drilling-ban\/\">can act directly<\/a> to reverse it. But a close reading of the law suggests that it could be difficult to undo Obama\u2019s sweeping act.<\/p>\n<h2>The power to withdraw<\/h2>\n<p>Congress passed the law now known as the <a href=\"https:\/\/www.boem.gov\/Outer-Continental-Shelf-Lands-Act\/\">Outer Continental Shelf Lands Act<\/a> in 1953 to assert federal control over submerged lands that lie more then three miles offshore, beyond state coastal waters. Section 12(a) of the law authorizes the president to \u201cwithdraw from disposition any of the unleased lands of the outer Continental Shelf.\u201d <\/p>\n<p>Starting in 1960 with the Eisenhower administration, <a href=\"https:\/\/www.nrdc.org\/sites\/default\/files\/briefer-on-ocsla-withdrawal-authority_20161121_0.pdf\">six presidents<\/a> from both parties have used this power. Most withdrawals were time-limited, but some were long-term. For example, in 1990 President George H. W. Bush permanently banned oil and gas development in California\u2019s Monterey Bay, which later became a <a href=\"http:\/\/montereybay.noaa.gov\/\">national marine sanctuary<\/a>.<\/p>\n<figure class=\"align-center \">\n            <img alt=\"\" src=\"https:\/\/62e528761d0685343e1c-f3d1b99a743ffa4142d9d7f1978d9686.ssl.cf2.rackcdn.com\/files\/151502\/width754\/image-20161231-29218-1ti1lx0.jpg\"><figcaption>\n              <span class=\"caption\">Kelp forests in the Monterey Bay National Marine Sanctuary support many marine species.<\/span><br \/>\n              <span class=\"attribution\"><a class=\"source\" href=\"https:\/\/www.flickr.com\/photos\/onms\/28127778655\/in\/album-72157654010239946\/\">Chad King, NOAA\/Flickr<\/a><\/span><br \/>\n            <\/figcaption><\/figure>\n<p>President Obama used section 12(a) in 2014 to protect <a href=\"https:\/\/www.whitehouse.gov\/the-press-office\/2014\/12\/16\/president-obama-protects-alaska-s-bristol-bay-future-oil-and-gas-drillin\">Alaska\u2019s Bristol Bay<\/a>, one of the most productive wild salmon fisheries in the world. In 2015 he took the same step for approximately 9.8 million acres in the biologically rich <a href=\"https:\/\/www.whitehouse.gov\/the-press-office\/2015\/01\/27\/presidential-memorandum-withdrawal-certain-areas-united-states-outer-con\">Chukchi and Beaufort seas<\/a>.  <\/p>\n<p>Obama\u2019s latest action bars energy production in 115 million more acres of the Chukchi and Beaufort seas \u2013 an area known as the \u201c<a href=\"https:\/\/www.nrdc.org\/resources\/beaufort-and-chukchi-seas-protecting-americas-arctic\">Arctic Ring of Life<\/a>\u201d because of its importance to Inupiat Peoples who have lived there for millennia. The order also withdraws 3.8 million acres off the Atlantic Coast from Norfolk, Virginia to Canada, including several unique and largely unexplored <a href=\"http:\/\/www.chesapeakequarterly.net\/V14N3\/main1\/\">coral canyons<\/a>.  <\/p>\n<h2>Why Obama acted<\/h2>\n<p>In a <a href=\"https:\/\/www.whitehouse.gov\/the-press-office\/2016\/12\/20\/presidential-memorandum-withdrawal-certain-portions-united-states-arctic\">Presidential Memorandum<\/a> on the Arctic withdrawals, Obama provided three reasons for his action. First, he asserted, these areas have irreplaceable value for marine mammals, other wildlife, wildlife habitat, scientific research and Alaska Native subsistence use. Second, they are extremely vulnerable to oil spills. Finally, drilling for oil and responding to spills in Arctic waters poses unique logistical, operational, safety and scientific challenges. <\/p>\n<p>In ordering the Atlantic withdrawals, Obama <a href=\"https:\/\/www.whitehouse.gov\/the-press-office\/2016\/12\/20\/presidential-memorandum-withdrawal-certain-areas-atlantic-coast-outer\">cited<\/a> his responsibility to \u201censure that the unique resources associated with these canyons remain available for future generations.\u201d<\/p>\n<p>Market forces support Obama\u2019s action. Royal Dutch Shell <a href=\"https:\/\/www.adn.com\/energy\/article\/shell-drops-arctic-drilling-plans\/2015\/09\/28\/\">stopped drilling<\/a> in the Chukchi Sea in 2015 after spending US$7 billion and drilling in what proved to be a dry hole. Since 2008 the Interior Department has <a href=\"https:\/\/www.boem.gov\/Alaska-Leasing\/\">canceled or withdrawn<\/a> a number of sales in Alaskan waters due to low demand. Shell, ConocoPhillips, Statoil, Chevron, BP and Exxon have all to some degree <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2016-05-10\/big-oil-abandons-2-5-billion-in-u-s-arctic-drilling-rights\">abandoned offshore Arctic drilling<\/a>. <\/p>\n<figure class=\"align-center \">\n            <img alt=\"\" src=\"https:\/\/62e528761d0685343e1c-f3d1b99a743ffa4142d9d7f1978d9686.ssl.cf2.rackcdn.com\/files\/151501\/width754\/image-20161231-29225-ujew6e.png\"><figcaption>\n              <span class=\"caption\">The Beaufort and Chukchi seas are zones of the Arctic Ocean off the coast of northern Alaska.<\/span><br \/>\n              <span class=\"attribution\"><a class=\"source\" href=\"https:\/\/upload.wikimedia.org\/wikipedia\/commons\/9\/94\/Chukchi_Sea.png\">Mohonu\/Wikipedia<\/a>, <a class=\"license\" href=\"http:\/\/creativecommons.org\/licenses\/by-sa\/4.0\/\">CC BY-SA<\/a><\/span><br \/>\n            <\/figcaption><\/figure>\n<p>Low oil prices coupled with high drilling costs make business success in the region a risky prospect. Lloyd\u2019s of London <a href=\"https:\/\/www.lloyds.com\/%7E\/media\/files\/news%20and%20insight\/360%20risk%20insight\/arctic_risk_report_webview.pdf\">forecast this scenario<\/a> in a 2012 report that called offshore drilling in the Arctic \u201ca unique and hard-to-manage risk.\u201d <\/p>\n<h2>What happens next?<\/h2>\n<p>Critics of President Obama\u2019s action, including the state of Alaska and the U.S. Chamber of Commerce, say they may <a href=\"http:\/\/www.cnbc.com\/2016\/12\/22\/arctic-drilling-ban-chamber-of-commerce-may-sue-obama-administration.html\">challenge Obama\u2019s order in court<\/a>, in hopes that the Trump administration will opt not to defend it. But environmental groups, which <a href=\"http:\/\/www.commondreams.org\/news\/2016\/12\/20\/incredible-victory-obama-bans-drilling-parts-arctic-and-atlantic\">hailed Obama\u2019s action<\/a>, will seek to intervene in any such lawsuit. <\/p>\n<p>Moreover, to demonstrate that they have standing to sue, plaintiffs would have to show that they have suffered or face imminent injury; that this harm was caused by Obama\u2019s action; and that it can be redressed by the court. Market conditions will make this very difficult.   <\/p>\n<p>The Energy Information Administration currently <a href=\"https:\/\/www.eia.gov\/outlooks\/steo\/report\/prices.cfm\">projects<\/a> that crude oil prices, which averaged about $43 per barrel through 2016, will rise to only about $52 per barrel in 2017. Whether these areas will ever be commercially viable is an open question, especially since rapid changes are taking place in the electricity and transportation sectors, and other coastal areas are open for leasing in Alaska\u2019s near-shore waters and the Gulf of Mexico. <\/p>\n<figure><figcaption><span class=\"caption\">The Royal Dutch Shell drilling rig Kulluk broke loose and ran aground near Kodiak Island in the Gulf of Alaska as it was being towed to Seattle for winter maintenance in December 2012. This Coast Guard overflight video shows the harsh conditions along Alaska\u2019s coast in winter.<\/span><\/figcaption><\/figure>\n<p>Alternatively, Donald Trump could issue his own memorandum in office seeking to cancel Obama\u2019s. However, section 12(a) does not provide any authority for presidents to revoke actions by their predecessors. It delegates authority to presidents to withdraw land unconditionally. Once they take this step, only Congress can undo it. <\/p>\n<p>This issue has never been litigated. Opponents can be expected to argue that Obama\u2019s use of section 12(a) in this manner is unconstitutional because it violates the so-called \u201c<a href=\"https:\/\/www.law.cornell.edu\/wex\/nondelegation_doctrine\">nondelegation doctrine<\/a>,\u201d which basically holds that Congress cannot delegate legislative functions to the executive branch without articulating some \u201cintelligible principles.\u201d<\/p>\n<p>However, one could argue that Obama\u2019s action was based on an articulation of intelligible principles gleaned from the stated policies of the OCSLA, which recognizes that the \u201cthe outer Continental Shelf is a vital national resource reserve held by the Federal Government for the public.\u201d The law expressly recognizes both the energy and environmental values of the OCS. Thus President Obama\u2019s decision reflects a considered judgment that the national interest is best served by protecting the unique natural resources of these areas, while at the same time weaning the nation from its dangerous dependence on fossil fuels.  <\/p>\n<figure class=\"align-center \">\n            <img alt=\"\" src=\"https:\/\/62e528761d0685343e1c-f3d1b99a743ffa4142d9d7f1978d9686.ssl.cf2.rackcdn.com\/files\/151504\/width754\/image-20161231-29240-1w6z4ag.jpg\"><figcaption>\n              <span class=\"caption\">Exxon Mobil CEO Rex Tillerson, Donald Trump\u2019s choice for secretary of state, shakes hands with Russian President Vladimir Putin in 2012 after signing an agreement with Russian state-owned oil company Rosneft. The companies\u2019 joint venture to develop energy resources in Russia\u2019s Arctic waters has been blocked by U.S. sanctions on Russia since 2014.<\/span><br \/>\n              <span class=\"attribution\"><a class=\"source\" href=\"http:\/\/www.apimages.com\/metadata\/Index\/Russia-Putin\/13b0af98bb3743a89608904a33cc236b\/4\/0\">AP Photo\/RIA-Novosti, Mikhail Klimentyev, Presidential Press Service<\/a><\/span><br \/>\n            <\/figcaption><\/figure>\n<p>The section 12(a) authority is similar in some respects to the authority granted by the <a href=\"https:\/\/theconversation.com\/how-the-antiquities-act-has-expanded-the-national-park-system-and-fueled-struggles-over-land-protection-56454\">Antiquities Act<\/a>, which authorizes the president to \u201creserve parcels of land as a part of [a] national monument.\u201d Like the OCSLA, the Antiquities Act does not authorize subsequent presidents to undo the designations of their predecessors. Obama has also <a href=\"http:\/\/www.nytimes.com\/2016\/08\/28\/opinion\/sunday\/obama-the-monument-maker.html\">used this power extensively<\/a> \u2013 most recently, last week when he designated <a href=\"http:\/\/www.nytimes.com\/2016\/12\/28\/us\/politics\/obama-national-monument-bears-ears-utah-gold-butte.html?_r=0\">two new national monuments<\/a> in Utah and Nevada totaling 1.65 million acres.<\/p>\n<p>Some laws do include language that allows such actions to be revoked. Examples include the <a href=\"http:\/\/www.publiclandsforthepeople.org\/wp-content\/uploads\/2015\/05\/ORGANIC-ACT-OF-1897.pdf\">Forest Service Organic Administration Act<\/a>, under which most national forests were established, and the <a href=\"https:\/\/www.blm.gov\/or\/regulations\/files\/FLPMA.pdf\">1976 Federal Land Policy and Management Act<\/a>, which sets out policies for managing multiple-use public lands. The fact that Congress chose not to include revocation language in the OCSLA indicates that it did not intend to provide such power.<\/p>\n<h2>What can the new Congress do?<\/h2>\n<p>Under Article IV of the Constitution, Congress has plenary authority to <a href=\"https:\/\/www.law.cornell.edu\/constitution\/articleiv\">dispose of federal property<\/a> as it sees fit. This would include the authority to open these areas to leasing for energy development. Members of Alaska\u2019s congressional delegation are considering introducing legislation to override Obama\u2019s drilling ban. But Democrats could filibuster to block any such move, and Republicans \u2013 who will hold a 52-48 margin in the Senate \u2013 would need 60 votes to stop them. <\/p>\n<p>On the other hand, Congress may be content to let President-elect Trump make the first move and see how it goes in court. If Trump attempts to reverse the withdrawal, environmental groups contesting his decision would face some of the same obstacles as an industry challenge to Obama\u2019s action. It could be especially challenging for environmental groups to show that the claim is \u201c<a href=\"https:\/\/www.law.cornell.edu\/wex\/ripe\">ripe<\/a>\u201d for judicial review, at least until a post-Obama administration acts to actually open up these areas for leasing.
